so what can be done to a motorcyclist who is captured by "the man" while riding next to rail road tracks ?

is this tresspassing?

From my distant memories of law enforcement, I do not believe that any vehicle can travel on any train tressel (bridge), or on any of the gravel adjacent to the tracks.  That area is considered private property owned the the railroad.

If I remember correctly.

Yes.........positivily............and absolutly...........it IS treaspassing. Railroad tracks and the RofW's (right of way's) that they run on are PRIVATE PROPERTY, just like any place you may currently work now. They are not roadways, trails, forest roads, etc. that is open to the public for transportation. Any time you are on the RofW of any railroad for any reason, you are trespassing and are subject to being arrested. Normally, with the first occurance, you are detained briefly and all your information is taken down and logged in the computer. The second offence means a automatic $500.00 fine. Lord knows, you DON'T want a third offece. Mind you, I'm talking about the Railroad Police, not the local authorities.

At any rate, DO NOT EVER ride a bike, ATV, horse, pig or whatever OR walk on any raiilroads RofW. Especially on bridges! This will get you arrested (or killed) quicker than any other offence out there.

The railroad PD's and the local PD's and Sherriffs Dept.s are now working together more than ever to catch treaspasses. The railroad PD's will turn the video over to the locals law enforcement agencies and they will work closely together to figure out who you are. People get caught all of the time like this.

they will will closely together?? think The times that Ive passed a train on their RofW they just smile and give me the  Thumbs up. I think the railroad PD have more things to worry about than a random motorcycle on their RofW. I suspect the video cameras are there to prevent law suits in case of an accident. Heck, they can't even stop all the urban artist that use thier box cars as a canvas. And what about abandoned railroads? Better destoy the evidence Debandi.

I assure you xrDanL, the video cameras are there for more than law suit prevention, although yes, they're there for that purpose also. I've been closely following the railroad industry for years, and I can tell you whole heartedly that they absolutly frown on any trespassers, no matter how friendly the crews seem to be. The cameras are there to gather ANY evidence needed to prosocute ANY person for ANY reason. Just like police cars, the crew can and often do give a smile and a wave and then radio their dispatch center with locations and descriptions of offenders. This is immediatly radioed to local law enforcement who are then instructed to pick up and hold the offender if found. I know of many times when the local PD or sherriff office knows the offender from the description of clothing and/or vehicles, whethere SUV's, bikes, ATV's, or whatever, are are picked up for the railroad police.

As far as the railroad PD "having other things to worry about than a random motorcyle on their RofW", that and other trespassing activities is EXACTLY what they ARE worried about. Random motorcycles on a regular basis undermine the ballast (the rocks you see at the track) and creates problems with track alignment and drainage. Not to mention the numerous bike and atv riders that have been hit and killed by trains because they didn't hear them. YES! trains, when not blowing the horns, are much quieter than you think they are. Ribbon rail (very long lengths of rail now welded instead of bolted together) is very quiet. And trains at speed most times use the tonnage trailing the engines to help push the train on level or downhill sections, so motors are not pulling hard and not much noise is made.
